Agreement to Legal Terms

     The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.

     We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics. Our Content and Marks are protected by copyright and trademark laws in the United States and around the world.

     By using the Services, you represent and warrant that: all registration information you submit will be true, accurate, current, and complete; you have the legal capacity to comply with these Legal Terms; you are not a minor in the jurisdiction in which you reside; you will not access the Services through automated or non-human means.
  4. User Registration
     You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password.
  5. Purchases and Payment
     We accept: Visa, Mastercard, American Express, Discover, PayPal. All payments shall be in US dollars. Sales tax will be added to the price of purchases as deemed required.

     All sales are final and no refund will be issued.

     You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activities include: systematically retrieving data without permission, attempting to trick or defraud users, circumventing security features, using the Services for unauthorized commercial purposes, uploading viruses or malicious code, impersonating another user.

     The Services does not offer users to submit or post content publicly. When you create or make available any Contributions, you warrant that you are the creator and owner of the content and it does not infringe any third-party rights.

     By submitting suggestions or other feedback regarding the Services, you agree that we can use and share such feedback for any purpose without compensation to you.
  10. Services Management
     We reserve the right to monitor the Services for violations, take appropriate legal action against anyone who violates the law or these Legal Terms, and remove content that is excessive in size or burdensome to our systems.
  11. Privacy Policy
     By using the Services, you agree to be bound by our Privacy Policy posted on the Services.
  12. Term and Termination
     These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access, terminate your use, or delete your account at any time without warning.

     THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES’ CONTENT.
  3. Limitations of Liability
     IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. Our liability will at all times be limited to the amount paid by you to us during the one (1) month period prior to any cause of action arising.
  4. Indemnification
     You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim made by any third party due to: use of the Services; breach of these Legal Terms; violation of the rights of a third party.
  5. User Data
     We will maintain certain data that you transmit to the Services for the purpose of managing performance. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

     Visiting the Services, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements and notices we provide to you electronically satisfy any legal requirement that such communication be in writing.

    By providing your mobile number and opting in, you agree to receive text messages from Elevate SD Mobile Wash & Detail about quote requests, appointment confirmations and reminders, and service updates. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time.      These Legal Terms constitute the entire agreement and understanding between you and us. If any provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity and enforceability of any remaining provisions.
